Drumspot Charters LLC – Liability Waiver & Release of Claims

I understand that scheduling and payment for a charter trip is full agreement to this Liability Waiver & Release of Claims.

1. Assumption of Risk

I understand that participating in a fishing charter involves inherent risks, including but not limited to:

• Changing weather conditions
• Rough waters
• Slips, trips, and falls
• Sun exposure and heat-related illness
• Injuries from hooks, rods, knives, or fishing equipment
• Boat-related injuries
• Wildlife encounters
• Motion sickness

I voluntarily choose to participate in this activity with full knowledge of these risks and accept full responsibility for my safety.

2. Release of Liability

In consideration of being permitted to participate in a fishing charter operated by Drumspot Charters LLC, I hereby release, waive, and discharge Drumspot Charters LLC, Captain John, employees, partners, and affiliates from any and all claims or liabilities for:

• Personal injury
• Illness (including heat-related or allergic reactions)
• Property damage
• Loss of personal items
• Death
• Any other harm arising from participation in the charter

This release applies whether caused by negligence of Drumspot Charters LLC or otherwise, to the fullest extent permitted by Louisiana law.

3. Medical Fitness

I confirm that I am physically capable of participating in the charter and do not have any medical conditions that would increase my risk of injury. I understand it is my responsibility to bring any required medications (e.g., inhalers, EpiPens, seasickness remedies).

4. Safety Rules

I agree to follow all safety instructions provided by the Captain or crew, including:

• Wearing life jackets when required or recommended
• Remaining seated when instructed
• Handling rods, hooks, and knives safely
• No alcohol or drug consumption during the charter trip unless it is a prescribed medication in the prescription bottle. If your prescribed medication is a medication that causes drowsiness, please contact the Captain. We do not want you falling out of boat due to cognitive impairment.
• Not boarding or exiting the vessel without permission

Failure to follow safety rules may result in early termination of the charter with no refund.

5. Weather & Conditions

I understand that fishing and boating conditions are affected by weather, tides, and fish activity, and these factors are beyond the Captain’s control. There are no guarantees regarding fish quantity, species, or overall catch success.

6. Personal Belongings

I acknowledge that any personal property brought on board—phones, wallets, cameras, tackle, etc.—is my sole responsibility. Drumspot Charters LLC is not liable for loss or damage.

7. Media Release

I grant Drumspot Charters LLC permission to use photos or videos taken during the charter for promotional purposes (social media, website, marketing).

8. Binding Agreement

I have read and fully understand this Liability Waiver & Release of Claims. I accept it voluntarily and acknowledge that it is a binding contract under Louisiana law.
